This privacy policy ("Policy") explains the confidentiality principles at KIM Sp. z o.o. and includes information regarding the processing of your personal data and your rights. We ensure that we apply justified technical and organizational measures aimed at protecting personal data from loss, misuse, alteration, or unintended destruction. Personal data obtained from clients visiting the website www.kim24.pl ("Site") and using the services provided by KIM Sp. z o.o. electronically through the Site are processed and stored in accordance with the accepted practice of processing information and the personal data protection act. Legal basis: Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), referred to as GDPR.

We inform you that the administrator of your personal data is KIM Sp. z o.o. with its registered office in Warsaw, ul. Bartycka 114, 00-716 Warsaw, entered into the register of entrepreneurs of the National Court Register, kept by the District Court for the capital city of Warsaw in Warsaw, XIII Economic Department, under KRS number 0000106056, NIP: 844-18-09-717.

Acquiring Information and Data

Browsing the content of the Site can be done anonymously and does not require providing your data. Providing your personal data is voluntary. However, we note that due to the nature of some services and applicable legal provisions, using some services requires providing specific data.

Your personal data may be received directly from you, e.g., when you send us an email with a request for an offer, fill out a form on the Site, submit a complaint about a product, confirm the acceptance of our offer, or participate in a contest.

Based on consents and authorizations received from you, we also receive certain information from the Economic Information Bureau InfoMonitor S.A. (address: ul. Jacka Kaczmarskiego 77, 02-679 Warsaw). The most often collected information by the Company includes:

  1. Information and data obtained directly from Clients: surname and first name, email address, residential address, correspondence address, delivery address, telephone number, bank account number, and information about the bank managing the account,
  2. Information and data obtained from other entities: information and data obtained from the economic information bureau (in accordance with the provisions of the act on providing economic information and exchanging economic data).

Use of Collected Information

Your data will be processed for the following purposes:

  1. to conclude and perform contracts with KIM Sp. z o.o. counterparts (legal basis: Article 6(1)(b) GDPR) - for the duration of the contract and settlements after its conclusion;
  2. to fulfill the legal obligations incumbent on KIM Sp. z o.o., e.g., issuing or storing invoices and other accounting documents, responding to complaints (legal basis: Article 6(1)(c) GDPR) – for the period prescribed by law,
  3. to determine the availability of various products and services offered by KIM Sp. z o.o. for individual Clients,
  4. for direct marketing, including sending ordered commercial information (legal basis: Article 6(1)(f) GDPR) – for the duration of the contract or until an objection is raised,
  5. for updating and expanding customer databases along with obtaining consents,
  6. for presenting marketing and sales campaigns, with the aim of increasing sales,
  7. for informing about changes concerning the company, the company website, current promotional actions, etc.
  8. for verifying payment reliability (legal basis: Article 6(1)(f) GDPR) – for the period necessary to make such an assessment when concluding, extending, or expanding the scope of the contract,
  9. for providing electronic services (legal basis: Regulation of the Minister of Interior and Administration of April 29, 2004, on personal data processing documentation and on the technical and organizational conditions which should be fulfilled by devices and computer systems used for processing personal data (Journal of Laws of 2004 No. 100, item 1024),
  10. for establishing, defending, and asserting claims (legal basis: Article 6(1)(f) GDPR
  11. for establishing, defending, and asserting claims (legal basis: Article 6(1)(f) GDPR) – for the period after which claims become statute-barred,
  12. in other cases - based on the consent previously given in the scope and purpose specified in the content of the consent (Article 6(1)(a) GDPR) – for the period from granting the consent to its withdrawal.

Who We Share Your Data With

Recipients of your personal data may be entities from the following categories: a. processing personal data on behalf of the Administrator based on appropriate agreements, e.g., entities servicing the Administrator's IT systems, subcontractors, advertising agencies, intermediaries, entities providing advisory, legal, debt collection, accounting, auditing services, and services for delivering correspondence and parcels, b. business partners (suppliers, manufacturers, producers), c. authorized to receive them based on applicable legal provisions e.g., courts and state bodies, d. entities authorized by you. KIM Sp. z o.o. does not transfer your personal data to entities located outside the European Economic Area.

How Long We Keep Your Data

Personal data will be stored by KIM Sp. z o.o. and/or the above-mentioned entities, solely for the time necessary to achieve the purposes for which the data are collected or to perform obligations resulting from legal provisions.

Your Rights Regarding Personal Data Processing

In connection with the processing of your personal data, you have the following rights:

  1. the right to access personal data, including the right to obtain a copy of these data;
  2. the right to request the rectification (correction) of personal data – if the data is incorrect or incomplete;
  3. the right to request the deletion of personal data (the right to be forgotten), in case when:
    • the data are no longer necessary for the purposes for which they were collected or otherwise processed,
    • the person to whom the data pertains objects to the processing of personal data,
    • the person to whom the data pertains withdraws consent on which the processing is based, and there is no other legal ground for processing,
    • the personal data is processed unlawfully,
    • the personal data must be deleted to comply with a legal obligation;
  4. the right to request restriction of personal data processing – in case when:
    • the person to whom the data pertains contests the accuracy of the personal data,
    • the processing is unlawful, and the person to whom the data pertains opposes the deletion of the data, requesting the restriction of their use instead,
    • the Administrator no longer needs the data for its purposes, but the person to whom the data pertains needs them for the establishment, exercise, or defense of legal claims,
    • the person to whom the data pertains has objected to processing pending the verification whether the legitimate grounds of the Administrator override those of the objection;
  5. the right to data portability – in case when all of the following conditions are met:
    • processing is based on a contract with the person to whom the data pertains or on consent expressed by this person,
    • processing is carried out by automated means;
  6. the right to object to data processing in case when there are reasons related to your particular situation, and the basis for processing is the necessity for the purposes resulting from legally justified interests pursued by the Administrator or by a third party (Article 6(1)(f) GDPR), except in situations when the Administrator:
    • demonstrates compelling legitimate grounds for processing that override the interests, rights, and freedoms of the person to whom the data pertains, requiring protection of personal data, especially when the person to whom the data pertains is a child, or
    • demonstrates grounds for the establishment, exercise, or defense of legal claims.
    If, however, the data is processed for direct marketing purposes (including profiling), you have the right to object at any time, and the Administrator will no longer be allowed to process the data for these purposes
  7. the right to withdraw this consent at any time, in case when the processing of personal data is based on the consent of the person to the processing of personal data (Article 6(1)(a) GDPR). Withdrawal does not affect the legality of processing carried out on the basis of consent before its withdrawal.
